Launch of consultation on legislation on indemnity insurance

The Department of Health have today issued a consultation on a proposal to introduce a requirement for healthcare professionals to have indemnity insurance.

The Department of Health is proposing that all healthcare professionals should be required to have professional indemnity insurance as a condition of registration. The Department's proposals do not extend to social workers in England. This requirement could be met through an employer or by holding separate cover which could be secured through a professional body.

The consultation will run for twelve weeks and views are sought from stakeholders including healthcare regulatory bodies. The HCPC will draft a response to the Department of Health's consultation which will be considered by the Council at their meeting on Wednesday 27 March 2013.

Over the coming months, we will draft guidance for our registrants to assist them in understanding how the legislation will affect them and also explain how we will check that insurance is in place. We will consult with our stakeholders on this guidance.
